Terms of Service

1. DEFINITIONS

ALICE GELATERIA (hereinafter referred to as "Alice Gelateria" or the "Seller") offers you an online shopping service enabling you to purchase items available in our online shop www.alicegelateria.com (hereinafter referred to as the "Site" or "Alice Gelateria") via the Internet.

The term "Purchaser" and “Buyer” means the person who makes the purchase, referred to in this Agreement.

The Purchaser, by sending his purchase order electronically, declares that he has read and accepted the Terms of Service (hereinafter, the "Terms" or the “Contract”) and payment terms transcribed below. Therefore, the transmission of the order implies full knowledge of the above Terms and their full acceptance.

The Buyer undertakes and is obliged, after the conclusion of the online purchase procedure, to print and keep these Terms of Service, which he has already read and accepted.

The goods and services that are the subject of these General Terms and Conditions are offered for sale by Alice Gelateria with registered office in Sagres, Rua de São Vicente, 8650-370, NIF 282886370.

2. OBJECT AND CONCLUSION OF THE CONTRACT

With the present Contract, respectively, the Seller sells and the Buyer purchases at a distance through telematic means only the tangible movable goods and services indicated and offered for sale on this Site.

The contract between the Seller and the Buyer is concluded exclusively through the Internet by means of the Buyer accessing the address of this Site, where, following the procedures indicated, the Buyer will formalise the purchase order of the goods offered for sale.

To purchase the products, the Buyer must duly complete and send the order form and correctly complete the purchase process up to the summary page containing the order number in electronic format, following the instructions contained on the Site.

The Purchaser shall:

  • add the products to the cart and, after having read the General Conditions and Privacy Policy,

  • enter the shipping and invoicing data,

  • select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Buyer acknowledges and declares that he has read all the information provided to him during the purchase procedure and fully accepts these General Terms and Conditions of Sale and payment transcribed herein.

Alice Gelateria shall send the Purchaser an email confirming the order containing the order number, the shipping and invoicing details, the list of products ordered with their essential characteristics and the total price, including any shipping costs.

It is not possible to change other elements of the order, such as, for example, the products and quantities.

The contract stipulated between Alice Gelateria and the Purchaser shall be deemed concluded only with the shipment of the products ordered.

3. PAYMENT AND REFUND METHODS

The Purchaser may pay for the products ordered and the related shipping costs by Credit Card or PayPal.

Refund requests are evaluated on a case-by-case basis. The Seller reserves the right to accept refund requests only in the following cases:

  • One or more damaged items;

  • One or more items missing;

  • Order not delivered due to package lost by courier.

Any request for refund must be accompanied by documentary and photographic evidence. In the absence of such evidence the Seller shall have the right to refuse the request.

Any reimbursement to the Buyer, if the latter is entitled to it, shall be credited by credit card, PayPal or bank transfer, no later than 30 (thirty) days from the date on which the Seller became aware of the cause generating the right to reimbursement.

4. TIME AND METHOD OF DELIVERY

The Seller will deliver the ordered products by the courier GLS, DPD or CTT (for Portugal) or, in cases where this is necessary, by other couriers.

Except in cases of force majeure or unforeseeable circumstances, the products ordered will be delivered to Portugal within a maximum period of 8 (eight) working days from the working day following the day on which the Seller has confirmed the order to the Buyer by means of an order confirmation email.

In the event that the Seller is unable to dispatch the goods within said term, the Purchaser will be notified promptly by email, indicating the term within which the order will be processed.

If the Purchaser's country of destination is not among those listed on the Site, the Purchaser may contact the Seller via the email address info@alicegelateria.com or through the contact form present on the Site to request a customised shipping quote.

Delivery times are to be considered indicative and may vary depending on the country of destination and other factors not directly controllable by the Seller and not attributable to it.

5. SHIPPING AND DELIVERY COSTS

The Purchaser has the possibility to check, before the conclusion of the order, from the drop-down menu on the payment page, the possibility of shipping to the country of his interest and the relevant delivery costs. Deliveries to some countries may be subject to payment of customs duties by the final consignee.

5. PRICES

All the sales prices of the products displayed and indicated on this website are inclusive of VAT and any other tax.

Shipping costs will be indicated and calculated in the purchase procedure prior to payment of the order by the Purchaser and also contained in the web page summarising the order placed. For more information on shipping costs, please refer to point 5 of these Conditions.

The prices indicated for each of the goods offered to the public are valid until the moment the order is placed and are indicated on the order summary web page.

Therefore, the prices and conditions may be changed by the Seller at any time and the Buyer shall be bound by what appears on the order summary web page.

7. PRODUCT AVAILABILITY AND ORDER CANCELLATION

The Supplier ensures, through the telematic system used, the processing and execution of orders within the terms of the Contract, except in the event of force majeure or unforeseeable circumstances.

The products displayed on the Site will be valid for as long as they remain advertised on the Site and, in any case, until stocks are exhausted.

Should one or more products be out of stock, the Seller will promptly inform the Buyer by e-mail of the unavailability of the product and the total or partial cancellation of his order.

  • In the event of total cancellation of the order: the Buyer shall be refunded without delay and at the latest within fourteen (14) days of payment of the sums paid by him.

  • In the event of partial cancellation of the order: the Buyer's order shall be validated and the full amount of the order shall be debited from the Buyer's bank account. The available products will be delivered to the Buyer. The amount of the product ordered and not available will be refunded as soon as possible and at the latest within fourteen (14) days of payment of the sums paid by the Buyer.

In accordance with applicable legislation, Alice Gelateria reserves the right to refuse or cancel any order in which the number of products for a single order or for several cumulative orders demonstrates the intention of the marketing of the same.

Finally, Alice Gelateria reserves the right to suspend or cancel the execution and/or delivery of an order, regardless of its nature and degree of execution, in the event of non-payment or partial payment of the costs due by the Buyer, in the event of payment incidents or in the event of fraud, whether committed or attempted, relating to the use of the Alice Gelateria website, including fraud committed on the basis of previous orders.

There shall be no return of orders by the Purchaser. For further information, please refer to section 11 of this contract.

8. LIMITATIONS OF LIABILITY

The Seller shall not be liable for inefficiencies attributable to force majeure or for inefficiencies or malfunctions related to the use of the Internet network outside of its control or that of its sub-suppliers.

The Seller shall not be liable to the Buyer, except in the event of wilful misconduct or gross negligence.

Furthermore, the Seller shall not be liable for damages, losses and costs suffered by the Buyer as a result of the non-execution of the contract for reasons not attributable to him, the Buyer being entitled only to a full refund of the price paid.

The Seller shall not be held liable for any fraudulent or illicit use that may be made by third parties, of credit cards when paying for purchased products if it can prove that it has taken all the precautions applicable at the time of the transaction.

9. GUARANTEES AND METHODS OF ASSISTANCE

The Vendor shall be liable for any ascertained defect or defect in the product and attributable to him, provided that such defect or defect is reported by registered letter with advice of receipt to Alice Gelateria, Rua de São Vicente, 8650-370, Sagres, or notified by e-mail to info@alicegelateria.com within 8 (eight) days from the date of delivery, with an indication of the type of defect found and photographic evidence attached.

10. OBLIGATIONS OF THE PURCHASER

The Purchaser undertakes to pay the price of the goods purchased in the time and manner indicated in the Contract.

The Purchaser undertakes, after the conclusion of the online purchase procedure, to print and keep the web page containing the order data.

The information contained in this Contract has, moreover, already been viewed and accepted by the Purchaser, who acknowledges that when finalising the order, he must confirm that he has viewed and accepted the Terms of Service.

11. COMMUNICATIONS AND COMPLAINTS

Direct written communications to the Seller and any complaints shall be deemed valid only if sent to the address Alice Gelateria, Rua de São Vicente, 8650-370, Sagres, or sent by e-mail to info@alicegelateria.com or through the Site using the contact form in the "Contacts" section.

The Buyer shall indicate on the registration form his or her residence and domicile, telephone number and e-mail address to which he or she wishes communications from the Seller to be sent.

Claims with a request for reimbursement shall only be considered in the event of damaged or missing goods, which therefore present obvious discrepancies between the goods purchased and those received.

Any damage or anomaly in the goods must be notified to the carrier and reported when the goods are collected SPECIFYING THE REASON FOR THE RESERVE (e.g. damaged parcel, missing parcel or other).

The Purchaser may, within 8 (eight) working days of receipt of the goods, report any problems by initiating a complaint procedure. No complaint shall be admissible after 8 (eight) working days from receipt of the goods.

The Seller shall be entitled to request photographic evidence from the Buyer to prove the non-conformity of the delivery.

If, following verification of the photographic proof, the non-conformity is confirmed, the Seller shall proceed to refund the Buyer the exact amount paid by the Buyer.

If the refund is partial and does not concern the entire order, any shipping costs paid by the Buyer shall not be reimbursed.

It is at the Seller's discretion, and in any case in agreement with the Buyer, to propose the return of non-compliant goods or to propose the issue and sending of a discount code that can be spent on the Seller's site.

The Seller reserves the right to reject a claim in the following cases:

  • incorrect, incomplete or unsuitable delivery address (based on the data provided by the Buyer at the time of purchase) or lack of a consignee reference visible to the shipper at the delivery address (e.g. house number or first and last name on the doorbell). The delivery information entered by the Buyer and recorded at the time of order shall bind the Buyer. In the event of an error in entering such delivery information, the Seller shall not be held liable for the inability to deliver the goods as a result of such error. Alice Gelateria shall make an attempt to contact the Purchaser (including by electronic means only), who shall be obliged to give a reply within 24 hours;

  • delivery not made due to the addressee being absent. Alice Gelateria shall make an attempt to contact the Buyer (also in an exclusively electronic manner), who is obliged to give a reply within 24 hours;

  • absence of photographs proving the state of the product if it is reported as non-compliant;

  • change of shipping address after the period of 2 hours from the time of order, or change of address made directly by the Buyer and not communicated to the Seller;

  • The Seller avails itself of the right to reject orders from Customers who have placed two orders and which have not been delivered.

12. DURATION AND EFFECTIVENESS OF THE CONTRACTUAL CONDITIONS

Confirmation of the order implies the Purchaser's acceptance of these General Terms and Conditions of Sale, which may be updated or amended directly by transcribing the new provision on this Site.

The amendment or update will be valid and effective for orders that have not yet been processed and for which the web page summarising the order data has not yet been displayed.

13. PRODUCT INFORMATION

Information and characteristics relating to the products are available, with the relevant product codes, on the Site.

The visual representation of the products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality, but may differ in colour, size and decorative elements (such as, but not limited to, ribbons and labels).

In the event of a difference between the image and the written product sheet, the product sheet description shall always prevail.

By concluding the online purchase procedure, the Purchaser declares that he has read the ingredients and allergens.

 14. PRODUCT INVOICING

If the purchase is made by a VAT subject, it will be possible to complete the NIF / VAT Nr field when checking out or request an invoice by sending an email to info@alicegelateria.com.

The Purchaser is responsible for the correct entry of invoicing data and is expressly informed that if the invoice is not requested during the order process, it will not be possible to request it later.
